Terms and Conditions

The Rental Agreement together with Terms and Conditions and Health & Safety information, will form the basis of your agreement with Galia Homes. They apply only to holiday arrangements which you book with us and which we agree to make, provide or perform as applicable as part of our agreement with you.

Please note, it is the requirements and standards of the country in which any services are provided and apply to those services which make up your holiday and not those of your home country. As a general rule, these requirements and standards will not be the same and may sometimes be lower.

1.      BOOKINGS

2.      PAYMENT

A 30% non-refundable deposit is required to secure your booking.
The final balance will become due eight weeks prior to arrival date.
If the time elapsed between the signing of this contract and the arrival date is less than 8 weeks, then the total rental fee is payable immediately. At the discretion of the owner the full amount or part may be paid on arrival in the event of a last minute booking. We can accept Euros via a Bank Transfer or PayPal, although we pass on any transaction fees arising.

3.      CANCELLATION

Changes by you:
If you terminate this contract before your arrival date, you are responsible for paying the following penalty fees to cover costs, as long as a further rental is not possible:

Termination

–        up to 8 weeks before rental period:                                                      deposit

–        8 weeks and less before rental period:                                                  100 % of rental price

We can thereafter let the property to someone else.
If you terminate your stay before the departure date for any reason, you are still obliged to pay the full rental price.

Should you be more than 8 weeks late in paying, we entitled to terminate the contract and let the property to someone else. (We shall always remind you regarding your balance payment about a week before it’s due. We also try to contact you by email or phone before we let the property to another tenant).

Changes by us:
It is unlikely that we will have to make any changes to your holiday. If there is a major change to your arrangements (i.e. a change of resort or a change to a lower or higher standard of accommodation) we will inform you as soon as reasonably possible if there is time before departure and will offer you alternative accommodation. Where this is cheaper we will refund the difference but where it is more expensive you will have to pay the difference, or cancel your arrangements and receive a full refund, but no compensation will be offered.

If, before departure, there is a minor change, we will do our best to inform you in advance although we are under no obligation to do so, nor are we obliged to pay compensation

4.      LIABILITY

1) No liability is accepted for events outside our control. We accept no liability for intermittent failure of public supplies or utilities such as water or electricity over which we have no control, nor of sewage systems, plumbing or mechanical/electric equipment in villas, but shall use our best endeavours to arrange prompt repairs where possible.

2) Please note that we do not offer compensation resulting from activities of theft or accept any liabilities for such matters both in or around the villa or in the resort.

In the event that you should lose any items of value whilst on holiday, through theft or otherwise, you must report the facts immediately to the local police and obtain a written report. If a report is not obtained it will be difficult for you to pursue any claim with your insurance company.

4) We shall have no legal liability whatsoever to you for any loss, damage, personal injury or death which you suffer arising directly or indirectly from any aspect of your holiday. You should ensure all members of your party have appropriate and adequate insurance for the duration of their stay. Loss or injury should be notified to your appropriate insurance company immediately.

5.      RENTAL

Payment of rental includes:

a) Midweek maid service with changing towels and final cleaning of the accommodation. Maid service doesn’t include cleaning of the kitchen appliances or dishes. If you stay more than 9 nights linen will be changed once weekly.

b) Electricity and Gas (Air conditioning, heating and pool heating are always extra)

c) Pool and garden maintenance once weekly

d) Baby cot and a high chair (at extra cost in some villas/apartments)

e) Extra folded bed in some villas and always at extra cost.

6.      DAMAGE DEPOSIT

We charge a Security Deposit of €100 for the apartment and €200-€500 for the villa which is used to protect villa owners or local suppliers against any breakages, loss, damage, unpaid local charges, additional housekeeping and any other charges. Where applicable, the cost of the Security Deposit will be included on your confirmation invoice and payable with your holiday balance. Where we cannot take a breakage deposit with your balance you should be prepared to pay it on arrival (only cash).  This amount will be refunded to you within 2 weeks of your return date less any damage, losses, unpaid bills etc. In the event of substantial damage/abuse to a villa, you will have to leave and find alternative accommodation at your own cost. Should the Security Deposit prove inadequate to fully cover any costs that arise, we reserve the right to invoice you for immediate payment.

Single Sex or Young Parties
All single sex and/or young parties will be charged a Security Deposit which will be included on your confirmation invoice and is payable with your holiday balance. Villa owners require us to charge higher levels for single sex and/or young parties

7.      ARRIVAL AND DEPARTURE

Arrivals and departures are controlled by the local administration.

You may take possession of the accommodation after 14.00 on the day of arrival, and must vacate the accommodation before 10.00 am local time on the last day of the rental.

You must guarantee that the accommodation will only be used by the maximum number of persons agreed at the booking date. Should be house be used by more than this number we have the right to charge a corresponding higher rent.

8.      RESPONSIBILITY OF THE TENANT

You are liable for any damaged goods, damage to the property or damage to anything else related to the property, whether caused by you or your accompanying guests or visitors.

Faults that are found before or during the rental period are to be reported to our Representative immediately.

All our properties are non-smoking. Please bare in mind that our next guests might have allergy/intolerance to smoking. Any extra cleaning related to a smell of smoking will be charged £150

On departure the kitchen appliances must be cleaned and rubbish must be taken out to the rubbish bin. We reserve the right to charge you additional £50 for cleaning a kitchen should we find the appliances and dishes not cleaned after your departure. Any extra cleaning duties in the villa (alcohol related problems) will be charged of £150

Please do not take out anything that belongs to the villa including the pool towels.

In case a towel will be lost or destroyed you will be charged £25 per item.

 Animals will not be accepted in the houses.

9.     MAXIMUM OCCUPANCY

You must not exceed the maximum specified occupancy for the villa type which you have booked.  The maximum occupancies are set on the villa’s description page.
One more person might be accepted at additional charge agreed prior your booking.

We reserve the right to charge you for extra people or termite your holidays. No refund will be offered.

10.    COMPLAINTS

Please be aware that any problems that occur during your stay must be reported to our Representative, so that quick solutions can be found to provide the best service, therefore making your holiday as enjoyable as possible. We cannot address issues that are not reported at the time of your stay or being given the opportunity to resolve them. Complaints not reported and made at a later date, are therefore not accepted.

 11.    INSURANCE

You should ensure they have appropriate and adequate insurance for the duration of their stay. Loss or injury should be notified to your appropriate insurance company immediately.

 12.    SWIMMING POOLS

Whether the accommodation has a private or communal pool we can accept no liability for the pool including any accidents that may occur. When a swimming pool has heating facilities it can be heated on request made no later than 4 weeks before arrival. The heating of the pool is always extra. 13.   ELECTRICITY

In summer month electricity is included in rental price. Air conditioning in the villas is on request and extra unless it stated otherwise on the villa webpage on the website. In winter months (November to March) cost of electricity is to be paid by tenant. This will be collected by our Representative at the end of the lease. The electricity will be charged according to the electric meter.

14.   AIRPORT TRANSFERS & CAR HIRE

We also act as agents for a Car Hire and Airport Transfer Companies.  Any contractual responsibilities are between you “The Client” and the Car Hire or Airport Transfer Company.

15.   TRAVEL DOCUMENTS

Before your arrival we supply you with local map with your accommodation on it, detailed directions to the villa/resort from Faro airport, contact number of our representative (a house keeper or a manager), details regarding key pick up, airport transfers and car hire.

It is the client’s responsibility to ensure that all their travel documentation (such as flight tickets, insurance policy documents, directions to your villa, information etc) are in order. Please check them carefully.

16.   BEHAVIOUR

1. We reserve the right in our absolute discretion to terminate your holiday or any holiday services if your behaviour is likely, in our opinion or that of our employees, Villa Representatives or suppliers, to cause distress, damage, annoyance or danger to our employees or to any third party, or their property. We will impose full cancellation charges and will not give any refunds. Furthermore, we will be under no obligation whatsoever to pay you compensation or cover any costs you may incur as a result of having to make alternative arrangements. We reserve the right to refuse or terminate any bookings that we think will be a nuisance to the owner.

17.  COMMERCIAL USE NOT PERMITTED 

Please note that our villas and holidays are provided for leisure and holiday purposes only. Sub-letting, sharing, assignment or reselling of our villas or holidays or otherwise using our villas or holidays for any commercial purpose (including, without limitation, for yoga or wellness retreats) is not permitted. Additionally, should any large gathering of people other than those noted on our invoice take place (e.g. a party or wedding reception) we must be informed about it at the time of booking. If we can accommodate this, you may be charged an extra cost for cleaning / maid service and a refundable security deposit may apply. We reserve the right to refuse your booking should we not be able to accommodate your request, or if the booking has already been confirmed, cancel the booking in which case our standard cancellation charges shall apply.

 Our villas are let for holiday purposes only and commercial activities may not be carried out.
We reserve the right to terminate your booking, without liability, should we find out about any commercial use made of our holidays/villas without our permission.

 GaliaHomes, its suppliers and agents cannot be held liable for any consequence of holding any commercial activity, event, or any other arrangement organised by you and not arranged by us, our agents or suppliers. Any arrangements made by you (with or without our written approval) should be protected by you with adequate liability insurance and any other regulatory requirements or licenses.

18. BUILDING WORKS

From time to time, building work and its associated noise is unavoidable. We do not control such work, and we do not receive advance notice of when it will begin. Where we are aware of such building work, we will notify you as soon as possible if we think that said works will affect your holiday. If we consider the work will have a significant effect on your holiday then you will be entitled to exercise the options shown in section 3 (Changes by us).

19.  EXCURSIONS AND RESORT SERVICES

We may provide you with information (on our website and/or when you are away) about activities and excursions which are available to purchase through independent suppliers in the area you are visiting. Where we have not agreed to arrange, provide or perform these activities or excursions as part of our agreement with you, subject to these booking conditions, we do not accept any responsibility for them even where we suggest or recommend a particular operator or supplier and/or assist you in any way in booking such activities or excursions. Some resort facilities, such as shops, restaurants, communal pools, water sports and water parks etc may not operate at all times and you should ask if such a facility is important to you. We accept no liability should any facility be closed.

20. PETS AND ANIMALS

The villas are booked for normal holiday use only and pets/animals are not allowed. Guide and assistance dogs are usually allowed, with the permission of the villa owner – please contact us before you confirm any booking.

21.   WEBSITE ACCURACY

Important note: the information and prices shown on this website may have changed by the time you come to book your arrangements. Although we make every effort to ensure the accuracy of the information and prices at the time of publishing, regrettably errors do occasionally occur. You must therefore ensure you check the price and all other details of your chosen arrangements with us at the time of booking.

All information in our website has been compiled from up to date details and we have taken care to ensure that it is accurate. There may however be occasions when an advertised facility is either modified or not available. Such situations may be dictated by local circumstances, necessity for maintenance, water shortages, unsuitable weather conditions, fuel shortages, power cuts and other circumstances beyond our control. If we are advised of this, then we will of course inform you as soon as possible, but we cannot be held liable in such circumstances. It is also important to remember that some facilities, such as shops, restaurants, communal pools, water sports and water parks etc may not operate at all times and may have closed.

It is not always possible to show photographs of all the facilities in our villas. Furniture may sometimes vary from website photographs. Please visit our website www.galiahomes.com for latest photography and most up to date property information. If a particular facility offered in our villa is essential to the booking of your holiday, please ensure that we are made aware of this at the time of booking.

 IMPORTANT NOTE

We accept no responsibility and shall not be liable in respect of loss or damage, cancellation or changes caused by reason of War, Riots, Civil Strike, Terrorist Acts, Fire, Flood, Natural Disasters, Closure of Airports, or other event beyond our control.

The local court (Portimão, Algarve, Portugal) where the accommodation is situated will be elected to act in case of any disagreement between the Agent and Tenant.
